NDC Tackles Delta Assembly For Declaring Udu Lawmaker’s Seat Vacant

The Nigeria Democratic Congress (NDC) has condemned the decision of the Delta State House of Assembly to declare the seat of the member representing Udu Constituency, Hon. Collins Egbetamah, vacant, describing the action as unconstitutional, politically motivated and a violation of the law.

In a statement issued by its National Publicity Secretary, Barrister Osa Director Esq., the party accused the Delta Assembly of engaging in “politics of vindictiveness and selective justice” against the lawmaker following his defection from the All Progressives Congress (APC) to the NDC.
According to the party, Egbetamah was originally elected into the House on the platform of the APC and remained a minority legislator until Governor Sheriff Oborevwori and several members of the Assembly defected from the Peoples Democratic Party (PDP) to the APC.
The NDC alleged that after the governor’s loyalists joined the APC, Egbetamah was perceived as a political threat because of his status as an original APC member and his loyalty to former Deputy Senate President, Sen Ovie Omo-Agege.
It further claimed that the lawmaker was subsequently denied his salaries and other entitlements for several months by the Assembly on the directive of the Delta State Government.
The party said Egbetamah resigned from the APC and joined the NDC on April 30, 2026, adding that his decision was met with “vindictiveness, political callousness and indignity” by the state government and the Assembly.
Describing the declaration of his seat vacant as “politically unprecedented,” the NDC argued that the action violated the constitutional rights of the lawmaker to freedom of association and assembly.

The opposition party called on the Independent National Electoral Commission (INEC) to disregard what it described as an illegal action by the Delta State House of Assembly.
The NDC also disclosed that it would pursue all available legal remedies to challenge the Assembly’s decision, while urging the lawmakers to allow Egbetamah to continue performing the constitutional responsibilities for which he was elected by the people of Udu Constituency.

The party reaffirmed its commitment to ensuring that residents of the constituency continue to enjoy effective representation and the dividends of democracy, insisting that “no form of legislative rascality” should be allowed to undermine the mandate freely given by the electorate.
